The option of using non-binding mediation in an environment of reduced tensions and hostilities often provides a platform on which parties, with the help of a neutral mediator, can more objectively evaluate their respective positions and the settlement alternatives suggested by the mediator. Nielsen & Senior’s experience in the area of mediation includes the preparation of memoranda for the use of the mediator and opposing counsel that state clearly the position of Nielsen & Senior’s clients, outlining the relevant facts and law upon which the clients rely, and the evaluation of the briefs used by the opposing partys’ attorneys. All of this occurs in a private and confidential setting and, in a high percentage of cases, results in the achievement of an acceptable resolution of disputes.

Arbitration

Arbitration is another alternative for handling disputes in which Nielsen & Senior has many years of experience. In that regard, one of its attorney’s, for more than twenty years, has served as a member of commercial and arbitration panels of the American Arbitration Association. We have the qualifications to represent clients in the arbitration process who understand arbitration procedures, and have represented clients in the arbitration of claims ranging from a few thousand dollars to several million dollars.
