Eminent Domain & Takings

The state of Utah condemns thousands of properties each year through eminent domain. Eminent domain is the process by which the government can acquire privately owned real property or a property right that is to be used for public projects in Utah such as roads without the owners consent. In such takings the government can either aquire a complete property or only a partial property right such as an easement. When property or property rights change hands through eminent domain takings, the government must provide just compensation to the property owner.
