A claim can be made against a hospital, doctor, dentist or other healthcare provider if a mistake is made that causes harm to the patient. Typically the claim must be proven through an expert witness. For a claim to be proved against a certain type of physician, another physician in the same field must testify that there was a deviation from the standard of care. To bring a claim, a notice of claim must be send to the healthcare provider. Then the evidence must be presented to a prelitigation panel where a non-binding decision of meritorious or non-meritorious is rendered. After that a lawsuit can be brought.
