Products Liability

If you have been injured by a faulty or defective product, you may have what is commonly called a “product liability” claim. A product liability claim is typically brought against any manufacturer involved in the initial production of the product and anyone else in the chain of manufacture such as other manufacturers of parts, a distributor of the product, even the store owner who sold the product. A product liability claim is typically based upon state law claims of negligence, strict liability, and other causes such as a breach of warranty of fitness. Product liability claims can be brought for design defects which are inherent dangers that exist before the product is manufactured; for manufacturing defects that include defects or dangers that result from the negligent or faulty manufacture of the product; and/or marketing defects such as not the manufacturer’s failure to include the proper instructions for use of the product with the packaging. If you believe, you have a potential product liability claim, it is important to keep the product in your control. You should be careful to maintain the products’ condition, as it is found after the injury, to the extent you can. Also remember that you must bring a claim within a certain period of time or your claim could be forever barred.
