A common problem in motor vehicle accidents is the person at fault does not have enough liability insurance to compensate the injured person for his/her injuries. This is a common problem in Utah since the required liability limits are so low. It is important to see in that situation whether or not there is underinsured motorist coverage. A claim can be made against a person’s own underinsured motorist insurance if the liability insurance is inadequate. However, caution must be exercised because notice must be given to the underinsured motorist carrier of a tender of the policy limits in order to preserve the underinsured motorist claim.
